BrownGreer has handled some of the largest and most complex medical device and pharmaceutical settlements in U.S. history, and that experience has formed the bedrock from which we have built our services.
Our origins are rooted in the Dalkon Shield Claimants Trust, which included more than 300,000 claims from women who suffered a range of traumatic injuries from the intrauterine device. Lynn Crowder Greer served as both general counsel and later as executive director, while Orran Brown, Sr. advised the Trust’s management, Trustees, and other counsel. Through their efforts, the program concluded eight years ahead of schedule.
With their partnership emerging as BrownGreer, we have successfully brought numerous other medical device and pharmaceutical settlements and programs to a successful conclusion. Among other programs, this has included:
- Currently serving as the Claims Administrator in the “Fen-Phen” Diet Drug settlement, which includes a $5 billion trust established for more than 700,000 claimants.
- The $4.85 billion Vioxx settlement, where BrownGreer served as Claims Administrator in a program that resolved claims that the painkiller manufactured by Merck caused heart attacks and strokes.
- The U.S. ASR Hip Settlement Program, where BrownGreer paid $1.9 billion to 7,800 claimants, with 90 percent of claims being processed in fewer than three months.
In addition to notice, claims review, and handling payments, our services in medical device and pharmaceutical programs often include:
- Developing procedures
- Establishing matrix tables
- Preparing injury categorizations
- Handling other organizational requirements
We regularly handle applying matrices developed by external parties at the claims processing stage, in which we provide claimants unparalleled attention and compassion for their unique experiences.
In 2022, BrownGreer became administrator of the National Opioid Settlement, which resolves litigation against opioid manufacturers, marketers, and retailers. We serve in the same capacity in the Tribal Opioid Settlement.
